The challenges facing government continue to grow in volume and complexity as cyber security threats constantly evolve. More than 16 million records from government and military organizations were involved in a data breach in 2012 alone. A city government is included in the list of top 10 government breaches of 2012. And you’ve no doubt heard about the millions of passwords exposed due to attacks against LinkedIn and Twitter. The cyber security threats continue to explode at alarming speeds. Our ability to understand the risks, and know what role we play in defending against those has never been more important.

Clash of Public v. Private Interests as a Potential Source of Severe Public Officials Claims

Recent activity around the relative roles of state and local governments in controlling the process of hydraulic fracturing (“fracking”) in natural gas extraction reminds us of the potential for severe claims when public officials make land use decisions. It also raises new questions about how much risk pools are taking on when they cover these claims.

As natural gas becomes more valuable and the environmentally controversial fracking process becomes more cost-effective, some local governments are seeking to ban or regulate the “fracking” process within their borders. State governments and private interests are striking back in the courts, seeking to limit localities’ ability to press these initiatives. One case from New York illustrates the resulting peril to local governments and to risk pools that provide them with land use liability coverage.

Parks and Recreation: Top Five Types of Injuries and Prevention Tips

(Reprinted with permission of TML IRP. The following article was written by Ronnie Sexton, Loss Prevention Training Specialist and featured in the January-March 2013 Loss Prevention News)

As parks and recreation departments prepare for mowing, trimming, cleaning, painting, and many other springtime activities, safety programs should be reviewed. Reviewing accident and injury data from the 2011-2012 fund year provides a guide for prevention efforts. During 2011-2012, parks and recreation departments reported 985 workers’ compensation claims. Of these claims, there were five types of injuries accounting for 72% of the total claims. Concentrating on preventing the following top five injuries will address some major issues: strains, contusions, dermatitis, lacerations and punctures.

Campaign to Prevent Falls in Construction

The Occupational Safety and Health Administration (OSHA), the National Institute for Occupational Safety and Health (NIOSH) and the National Occupational Research Agenda (NORA) Construction Sector Council are rolling out a construction fall prevention campaign. The campaign focuses on falls from ladders, scaffolds and roofs, which are a hazard for many municipal workers and potential losses for their risk pools. Training, information, flyers and videos are available at the campaign website.

New Executive Director Appointed to South Dakota Public Assurance Alliance

Judith Payne was recently appointed as the Executive Director to the SD Public Assurance Alliance, the property and liability pool sponsored by the SD Municipal League.  Judy brings a wealth of risk management experience to the position, including developing, implementing, and administering the risk management program for the State of South Dakota.  Prior to joining SDPAA, she was most recently  serving as Special Assistant to the President of Dakota State University.
